Terms and Conditions

1. Renter's Acknowledgment

By signing this Agreement, Renter ("Customer") acknowledges that they have received the equipment described above in good working order and satisfactory condition, and agrees to return it in the same condition, reasonable wear and tear excepted. Renter confirms they have the legal authority to enter into this Agreement and are at least 18 years of age.

2. Rental Period and Rates

The rental period begins when Customer takes possession of the equipment and ends when Wild Sky Equipment confirms receipt of returned equipment. Rates are charged per full day (or weekly/monthly period, as selected). A new rental day begins at the same time of day the rental started. If the equipment is not returned by the agreed return date and time, additional rental charges will accrue automatically at the daily rate until the equipment is returned.

3. Payment

  • Payment is due in full prior to or at the time of equipment pickup or delivery.
  • Wild Sky Equipment accepts cash, credit/debit card, and approved payment methods.
  • A security deposit may be required and will be returned within 5 business days of equipment return, less any deductions for damage, late fees, cleaning, or outstanding charges.
  • Returned checks are subject to a $35 returned check fee.

4. Delivery and Pickup

If delivery is selected, Customer must ensure a safe, accessible location is available at the delivery address. Wild Sky Equipment is not responsible for delays caused by inaccessible sites or failure to have the site ready at the agreed delivery time. Delivery fees are non-refundable once delivery has been made. Customer is responsible for the equipment from the moment it is delivered or picked up until it is returned to Wild Sky Equipment's possession.

5. Renter's Responsibilities

  • Renter is responsible for proper and lawful use of the equipment at all times.
  • Renter must operate equipment only for its intended purpose and in accordance with manufacturer guidelines.
  • Renter must not allow unauthorized persons to operate the equipment.
  • Renter must immediately notify Wild Sky Equipment of any damage, malfunction, accident, or theft.
  • Renter must return equipment clean and in the same condition as received. A cleaning fee of up to $150 may be assessed for equipment returned in unsatisfactory condition.
  • Renter is responsible for all fuel, fluids, and consumables used during the rental period.
  • Renter must not remove or alter any markings, serial numbers, or identification on the equipment.

6. Equipment Damage, Loss, and Theft

Renter is fully financially responsible for any damage to or loss of the equipment during the rental period, including damage caused by improper use, accident, vandalism, or theft. Damage costs will be assessed based on the actual cost of repair or replacement as determined by Wild Sky Equipment. The security deposit will be applied first; Renter is responsible for any amounts exceeding the deposit. Wild Sky Equipment's determination of damage and repair costs is final.

7. Prohibited Uses

Renter agrees that the equipment will NOT be used:

  • For any unlawful purpose or in violation of any applicable laws or regulations.
  • In a reckless or negligent manner.
  • Outside the geographic boundaries agreed upon at time of rental.
  • For commercial purposes other than those disclosed at time of rental, unless expressly authorized in writing.
  • To tow, haul, or transport loads exceeding the equipment's rated capacity.

8. Equipment Inspection

Renter is responsible for inspecting the equipment at the time of pickup or delivery. Any pre-existing damage must be reported to Wild Sky Equipment before use. Failure to report pre-existing damage may result in Renter being held responsible for such damage upon return.

9. Fueling and Fluid Levels

Renter must return all equipment with the same fuel and fluid levels as at the time of pickup. Fuel surcharges of $6.00 per gallon may be applied for equipment returned with less than the original fuel level.

10. Late Returns

Equipment must be returned by the agreed return date and time. Equipment returned late will be charged at 1.5x the daily rental rate for each additional day or partial day until returned. Wild Sky Equipment reserves the right to retrieve equipment at Renter's expense if not returned within 48 hours after the agreed return date without prior arrangement.

11. Cancellations and Refunds

  • Cancellations made more than 48 hours before the rental start time will receive a full refund.
  • Cancellations made 24-48 hours before the rental start time will receive a 50% refund.
  • Cancellations made fewer than 24 hours before the rental start time are non-refundable.
  • Early returns do not qualify for a refund of unused rental days unless arranged in advance.

12. Indemnification

Renter agrees to indemnify, defend, and hold harmless Wild Sky Equipment, LLC, its owners, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to Renter's use of the equipment, breach of this Agreement, or any negligent or intentional act or omission by Renter.

13. Limitation of Liability

WILD SKY EQUIPMENT'S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL RENTAL FEES PAID BY RENTER UNDER THIS AGREEMENT. IN NO EVENT SHALL WILD SKY EQUIPMENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

14. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Idaho. Any disputes arising from this Agreement shall be resolved in the state or federal courts located in Ada County, Idaho. In the event of a dispute, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.

15. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the rental of the equipment and supersedes all prior negotiations, representations, or agreements. Any modifications must be made in writing and signed by both parties.
