These Terms of Service ("Terms") govern your use of the Wild Sky Equipment website (wildskyequip.com) and any related services, features, or platforms provided by Wild Sky Equipment ("Wild Sky Equipment," "we," "us," or "our"). By accessing our website, creating an account, or placing a reservation, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. About Wild Sky Equipment

Wild Sky Equipment is an equipment rental company based in Kuna, Idaho. We provide rental equipment — including trailers, excavators, skid steers, and related items — to contractors, homeowners, and businesses throughout the Treasure Valley region. Our primary service area includes Kuna, Boise, Meridian, Nampa, Caldwell, Eagle, Star, and Middleton, Idaho.

2. Eligibility

• You must be at least 18 years of age to rent equipment or create an account.
• You must have a valid government-issued ID and a valid credit or debit card.
• By using our services, you represent that all information you provide is accurate, complete, and current.
• We reserve the right to refuse service to anyone for any lawful reason.

3. Accounts

To reserve equipment online, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to your account. Wild Sky Equipment is not liable for any loss or damage arising from your failure to protect your login credentials.

4. Reservations and Bookings

• All reservations are subject to equipment availability and confirmation by Wild Sky Equipment.
• Reservations are not guaranteed until payment or a deposit has been received and you have received a written confirmation.
• Submitting a reservation does not guarantee the equipment will be available — we will contact you to confirm.
• Pricing displayed on the website is subject to change without notice and may not include delivery fees, applicable taxes, or deposits.

5. Cancellation and Refund Policy

Cancellations are subject to the following terms:

• Cancellations made more than 48 hours before the rental start time: full refund.
• Cancellations made 24-48 hours before the rental start time: 50% refund.
• Cancellations made fewer than 24 hours before the rental start time: no refund.
• No-shows or failure to be available for delivery at the scheduled time are treated as same-day cancellations.

Refunds, if applicable, will be processed to the original payment method within 5-10 business days. Wild Sky Equipment reserves the right to modify the cancellation policy for special events, peak seasons, or custom-built rentals.

6. Equipment Use

All equipment rentals are governed by a separate Equipment Rental Agreement and, where applicable, a Damage Waiver, which must be signed before equipment is released. In the event of any conflict between these Terms and the Rental Agreement, the Rental Agreement shall control.

7. Pricing and Payment

• All prices are listed in U.S. dollars and are exclusive of applicable taxes unless stated otherwise.
• Payment is due in full prior to equipment pickup or delivery unless other arrangements have been made in writing.
• Wild Sky Equipment reserves the right to charge the payment method on file for additional fees including but not limited to late return fees, damage charges, and cleaning fees.

8. Intellectual Property

All content on the Wild Sky Equipment website, including but not limited to text, images, logos, and graphics, is the property of Wild Sky Equipment or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without prior written consent.

9. Disclaimer of Warranties

THE WILD SKY EQUIPMENT WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WILD SKY EQUIPMENT DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WILD SKY EQUIPMENT AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 30 DAYS PRECEDING THE CLAIM.
